1 Grundsätzliches
- Seit 2019 besteht zwischen der EU und Japan ein Freihandelsabkommen.
- Auf Basis dieses Freihandelsabkommens kann beim Import eine Zollpräferenzbehandlung beantragt werden - d.h. es fällt u.U. nur die Einfuhrumsatzsteuer an und kein Zoll!
- Bestellungen von Cottages aus Japan werden in der Regel bei der Einfuhr durch das Transportunternehmen beim Zoll angemeldet. Das Transportunternehmen beantragt keine Zollpräferenzbehandlung, sondern geht den einfachsten Weg - Zollanmeldung, in Vorleistung die Importkosten begleichen und beim Empfänger des Pakets wieder kassieren.
- Als Empfänger holt man sich dann erstmal den Zollbescheid und legt dann Widerspruch gegen diesen Bescheid ein.
- Die Beantragung des Zollbescheids dauert ca. 3-4 Wochen und das Widerspruchsverfahren dauerte bei mir (Hauptzollamt Frankfurt a.M.) mehrere Monate.
2 Begründung des Widerspruchs
In der Begründung des Widerspruchs erklärt man, dass für die Waren eine Zollpräferenzbehandlung durch Vorlage einer "Erklärung zum Ursprung" gemäß Artikel 3.16 Absatz 2 a) des Freihandelsabkommens zwischen der EU und Japan beantragt wird.
2.1 Benötigte Unterlagen:
- Zahlungsnachweise (PayPal-Transfer, Kontoauszug)
- Rechnung
- Erklärung zum Ursprung
- alles was der Zoll sonst noch anfordert
3 Erklärung zum Ursprung (der ausgeführten bzw. eingeführten Waren)
Eine "Erklärung zum Ursprung" muss die Cottage aus Japan ausstellen und sie muss den genauen Wortlaut aus Anhang 3-D ("Annex 3-D") des Freihandelsabkommens haben. Hier der Link zu Anhang 3-D:
Jede dort aufgeführte Sprache ist zulässig, aber bevor ihr jemand in Japan etwas auf Finnisch ausfüllen lasst - nehmt Englisch.

(1 ) If the statement on origin is completed for multiple shipments of identical originating
products within the meaning of subparagraph 5(b) of Article 3.17, indicate the period for
which the statement on origin will apply. That period shall not exceed 12 months. All
importations of the product must occur within the period indicated. Where a period is not
applicable, the field can be left blank.
(2 ) Indicate the reference number through which the exporter is identified. For the European
Union exporter, this will be the number assigned in accordance with the laws and
regulations of the European Union. For the Japanese exporter, this will be the Japan
Corporate Number. Where the exporter has not been assigned a number, this field may

(3 ) Indicate the origin of the product; the European Union or Japan.
(4 ) Indicate, depending on the case, one or more of the following codes;
‘A’ for a product referred to in subparagraph 1(a) of Article 3.2;
‘B’ for a product referred to in subparagraph 1(b) of Article 3.2;
‘C’ for a product referred to in subparagraph 1(c) of Article 3.2, with the
following additional information on the type of product specific
requirement actually applied to the product;
‘1’ for a change in tariff classification rule;
‘2’ for a maximum value of non-originating materials or a minimum
